Wisner Law Firm brings action against Boeing for Emirates crash landing
Wisner Law Firm has filed a lawsuit on behalf of its clients, passengers of Emirates Air EK 521, in the Circuit Court of Cook County, Illinois, USA, against The Boeing Company, the manufacturer of the Boeing 777-300 aircraft, for physical and psychological injuries these passengers sustained in the crash landing of that flight on August 3, 2016.
Wisner Law Firm contends that the takeoff/go-around (TO/GA) switch on this aircraft was defectively designed. The switch is to be used by the pilots to apply power to the engines when executing a go around. However, the switch is inhibited or deactivated for several crucial seconds when the wheels of the aircraft touch the ground or come within a certain distance from the ground.
In EK 521, the aircraft either briefly touched ground or came within the preset distance of the ground, causing the TO/GA switch to be deactivated, and when the pilots applied the switch to apply power to the engines, no power was supplied and the aircraft fell back violently to the ground, injuring passengers and crew. There is no warning on the Boeing aircraft that the TO/GA switch has been deactivated and there is no clear warning in the Flight Operating Manual that this will occur under these circumstances.
